One mobile phone in genuine personal use is duty-free into India regardless of its value — and it does not count against your ₹75,000 allowance. What triggers ~38.5% duty is not the price. It is the sealed box. Here are the 2026 rules, the red vs green channel call, and how many phones you can actually carry.

Quick answer: Yes, and it is simpler than the internet suggests. India's Baggage Rules treat one mobile phone in genuine personal use as a personal effect — duty-free no matter what it cost, and it does not count against your ₹75,000 duty-free allowance. What triggers duty is not the price of the phone. It is the sealed box. Open it in Dubai, put your SIM in, use it, and walk through with your own phone.

Is it legal to bring an iPhone from Dubai to India?

Completely. This is a normal, everyday provision, not a grey area or a loophole.

Under the Baggage Rules, bona fide personal effects accompany a passenger duty-free. One mobile phone that shows genuine evidence of personal use falls squarely inside that. There is no value cap on it — a ₹1,79,900 Pro Max in your pocket with your photos on it is your phone, in exactly the way your watch and your laptop bag are your possessions.

What people confuse this with is *importing*. Carrying three sealed handsets for cousins and colleagues is a commercial import wearing a tourist's clothes, and customs officers see it several hundred times a day.

What is the duty-free allowance for India in 2026?

₹75,000 for passengers arriving by air, raised from ₹50,000 effective 2 February 2026. It covers the general run of goods you bring back — clothes, perfume, gifts, electronics accessories.

The important structural point, which almost nobody spells out: your one personal-use phone sits outside that allowance. It is not deducted from the ₹75,000. So the optimal basket for an Indian coming home from Dubai is one phone in use, plus up to ₹75,000 of everything else.

What makes customs treat a phone as new rather than personal?

Three signals, and they are all obvious on sight.

Whether it is still in sealed retail packaging. Whether the handset shows any evidence of having been used. And whether there is an active SIM and user data on it.

A boxed, shrink-wrapped phone fails all three at once. An unboxed phone with your Apple ID signed in, your SIM inserted and a week of photos on it passes all three without a conversation. The difference is fifteen minutes of setup in a Dubai hotel room.

How much duty do you pay if it is treated as an import?

Roughly 38.5% including the applicable surcharge, on the value of the device.

On a Pro Max valued around ₹1,43,100, that is close to ₹55,000 — which does not merely erase the ₹36,800 you saved, it puts you well behind where you would have been buying in India. That single number is why the sealed-box mistake is the most expensive one in this whole exercise.

Should you use the red channel or the green channel?

Green is for passengers with nothing dutiable and nothing restricted. Red is for everyone else.

One phone in personal use, and other goods under ₹75,000, is a green-channel walk. If you are over the allowance, or carrying gold beyond its own separate limits, or carrying more than one new phone, that is a red-channel declaration. Declaring and paying is an inconvenience. Being found in the green channel with undeclared dutiable goods is a different category of problem entirely.

How many phones can you carry to India?

You can physically carry several — the exemption is what is limited, not the luggage.

One phone per passenger gets the personal-effects treatment. Additional handsets are dutiable, and sealed ones invite the commercial-import reading. If two of you are travelling, that is two personal-use phones between two passengers, which is the legitimate way to bring back two devices.

What should you keep with you?

The invoice, always — it establishes what you paid and where. Keep the box if you like, but keep it in checked baggage rather than presenting the phone in it.

Set the phone up the day you buy it rather than the night before you fly. A device that has been live on a UAE or roaming network for several days, with photos and app data on it, tells its own story.
